The latest example of this is two separate lawsuits filed against Gökay Başcan, Editor-in-Chief of BirGün, and Selçuk Özbek, Managing Director of birgun.net.
The article at the centre of these cases was published in BirGün on 24 August 2025. Titled “You Cannot Intimidate Us with Punishment and Repression”, it covered the investigations launched against students for participating in the 19 March protests, as well as the suspension of their grants and their expulsion from halls of residence.
In the indictment prepared by the Press Offences Investigation Bureau of the Istanbul Chief Public Prosecutor’s Office, it was alleged that the article constituted the offence of “Publicly Insulting the Republic of Türkiye and the Government of the Republic of Türkiye”. The Istanbul 2nd Criminal Court of First Instance accepted the indictment, with the first hearing scheduled for 19 January 2027.
In another indictment prepared by the Press Offences Investigation Bureau of the Istanbul Chief Public Prosecutor’s Office, it was alleged that certain statements in the same news article constituted the offence of “publicly insulting the President”.
The indictment alleged that the statement in the news report, “It is not the resistance that is unlawful, but the political Islamist dictatorship of a single man”, constituted “words and statements that undermine the honour, dignity and reputation of President Erdoğan”.
The Istanbul 2nd Criminal Court of First Instance accepted the indictment, and the first hearing is scheduled for 4 February 2027.
